I also agree with Mr. Macnaghten that the objects aimed at by the Acts could, to a large extent at least, be attained by means of the Order in Council of 1896. Section 3 (4) of the Order in Council subjects all persons within the Colony affected to military law: Section 4 (3) and section 5 (4) & (5)

to some extent meet the requirements of Chap.29 section 1 (a) as amended by Chap.53 Section 1 (a). (Note that the Order in Council makes all persons Bubject to military law as if they were accompanying His Majesty's troops on active service beyond the seas.) Probably also some of the general prohibitions contained in this part of the Army Act would apply

to most cases coming within section 1 (b) of Chap. 29

as amended by section 1 (b) of Chap.63, and in this

connection attention may also be drawn to Article

4 of the Order in Council.

I think we might proceed as proposed by Mr.

Macnaghten informing the Governor that the Defence

of the Realm Acts and Regulations do not apply to

the Colony but that there is no objection, subject

to the question mentioned above as to the sufficiency

of the Order in Council, to his introducing similar

legislation.
